In consideration of being permitted by the CLUB NAMED BELOW of the ALMA MATER SOCIETY OF THE UNIVERSITY OF BRITISH COLUMBIA VANCOUVER‎ (“AMS”) to participate in any way in any AMS-sponsored and/or -hosted events and/or activities over the 12-month period (as applicable, the “Activities”) from and following the date I sign this Waiver and Release of Liability (“Waiver”), I agree to the following:

1. In connection with my participation in the Activities, I confirm that: (a) I do not have any medical or other conditions that would impair my ability to participate safely in the Activities; and [b] I will abide by any and all standards of conduct, rules and regulations governing my participation as may be established by AMS. I will also follow all instructions, recommendations, and cautions of AMS at all times during the Activities. If at any time I believe conditions to be unsafe or that I am no longer in proper physical condition to participate in the Activities, I will immediately discontinue further participation in the Activities.
2. I acknowledge and fully understand that there may be potential risks involved related to participation in the Activities such as the potential risk of damage to personal property or serious injury, including permanent disability and death, and social and economic losses which might result not only from my own actions, inactions or negligence, but the actions, inactions or negligence of others, and condition of the premises where the Activities are taking place.
3. I assume all of the foregoing risks and accept personal responsibility for all expenses, medical or otherwise, following any such damages, injury, permanent disability or death.
4. For myself, and on behalf of my heirs, executors, assigns, and personal representatives‎, I hereby release, waive, discharge and covenant not to sue AMS, the AMS Council, the University of British Columbia, and the owners and leasers of the premises where the Activities are taking place, and each of their respective executive, officers, employees, agents, licensees, consultants, independent contractors, subsidiaries, and affiliates (collectively, the “Releasees”), from any and all liability to me, my heirs and next of kin for any and all claims, demands, losses or damages on account of injury, including death or damage to property, caused or alleged to be caused in whole or in part by the ordinary negligence of the Releasees or otherwise. I understand that by signing this Waiver, I am waiving any and all claims, of any kind arising out of or attributable to my participation in the Activities, including those claims that may be unknown to me, or which I do not suspect to exist at this time.
5. I shall defend, indemnify, and hold harmless the Releasees against any and all losses, damages, liabilities, deficiencies, claims, actions, judgments, settlements, interest, awards, penalties, fines, costs, or expenses of whatever kind, including reasonable attorney fees, fees, the costs of enforcing any right to indemnification under this Waiver, and the cost of pursuing any insurance providers, incurred by the Releasees arising out of or resulting from any claim of a third party related to the Activities, including any claims arising out of my own negligence or the ordinary negligence of the Releasees.
6. I hereby consent to receive from any licensed hospital, physician, or medical personnel any medical treatment deemed necessary if I am injured or require medical attention during my participation in the Activities. I understand and agree that I am solely responsible for all costs related to such medical treatment and any related medical transportation and/or evacuation and I release all parties from any type of liability for anything that may happen during my treatment.
7. Participants nineteen (19) years of age and older may be able to drink alcohol during the Activities. However, alcohol consumption is at the participant’s own discretion, risk, and liability. Excessive alcohol consumption is not condoned by AMS. I hereby assume all risks involved with the consumption of alcohol and shall defend, indemnify, and hold harmless the Releasees.
8. I understand that my participation in the Activities may be photographed, filmed and/or otherwise recorded by AMS. Accordingly, I hereby grant to AMS a worldwide, perpetual, unlimited, royalty-free right and license to use my name, likeness, appearance, and performance of the Activities and other footage of me from the Activities in any and all media without further cost or expense to AMS, including edited ‎or otherwise modified versions thereof‎.
9. This Waiver constitutes the sole and entire agreement between AMS and me with respect to the subject matter contained herein and supersedes all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to such subject matter. If any term or provision of this Waiver is held invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other term or provision of this Waiver or invalidate or render unenforceable such term or provision in any other jurisdiction. This Waiver is binding on and shall inure to the benefit of AMS and me and our respective heirs, successors, and assigns. All matters arising out of or relating to this Waiver shall be governed by and construed in accordance with the laws of the Province of British Columbia. In entering into this Waiver I am not relying upon any oral or written representations or ‎statements made by AMS other than what is set forth in this Waiver.‎

BY SIGNING BELOW, I ACKNOWLEDGE THAT I HAVE READ AND FULLY UNDERSTOOD ALL OF THE TERMS OF THIS WAIVER AND THAT I AM VOLUNTARILY GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE AMS FOR CLAIMS, WHETHER KNOWN OR UNKNOWN, ARISING OUT OF MY PARTICIPATION IN THE ACTIVITIES.
